Ratio Decidendi

The High Court determined that it lacks jurisdiction to directly reassess a bill of costs taxed by the Deputy Registrar acting as taxing master. The proper procedure, upon a party's objection to the assessment, is for the High Court to consider the reference and, if merited, refer the matter back to a different taxing master for reassessment. Since both parties were amenable to a fresh taxation before another taxing master, and the applicant's grievance centered on the lack of reasons and alleged excessiveness of the taxed amount, the court found it appropriate to refer the bill of costs dated 4th June 2024 back to a different taxing master for reassessment.
