The Court of Appeal found that the applicant had satisfied both limbs required for a stay under Rule 5(2)(b): there was an arguable issue as to whether contempt could be found on a lapsed order, and the applicant would suffer prejudice if found in contempt, as such consequences could be irreversible even if the appeal succeeded. The court held that the seriousness of contempt proceedings and their potential penal consequences justified the grant of a stay of proceedings pending appeal. Accordingly, the court granted a stay of proceedings in the Employment and Labour Relations Court matter pending the hearing and determination of the appeal.
