Upon the death of the deceased, her share became part of her estate and could only be dealt with in accordance with the Law of Succession Act. The respondents failed to provide any documentation or explanation as to how they acquired the deceased's share, and the transfer was effected while the succession cause was pending and before confirmation of grant. This amounted to intermeddling with the estate, contrary to sections 45 and 82 of the Law of Succession Act.
