Ratio Decidendi

The court found that the appellants had not met the threshold for grant of stay of proceedings pending appeal as set out in Order 42 Rule 6(1) of the Civil Procedure Rules. The appellants failed to demonstrate substantial loss, did not file a defence in the lower court to controvert the respondent's averments, and the suit in the lower court remained undefended. The court held that staying the proceedings would hamper expeditious disposal of the lower court case and that the issues raised by the appellants could be addressed during the hearing and determination of the lower court suit. The application for stay was therefore unmerited and dismissed with costs.
