The appellants, having been joined to the suit only on 30/3/2022, promptly commissioned a valuation report which established that the value of the suit property was Kshs 20,000,000, exceeding the pecuniary jurisdiction of the lower court. This valuation report constituted new evidence that was not available to the appellants prior to their joinder. The lower court erred by dismissing the application for review on the ground that the issue of jurisdiction was an afterthought, and by misdirecting itself on the applicable legal test for review. The criteria under Order 45 rule 1 of the Civil Procedure Rules were satisfied, as the appellants could not have raised the jurisdictional issue...
