The plaintiffs in the current suit were not parties to the previous suit (Nairobi ELC Case No 264 of 2012), nor were they litigating under the same title or as privies. The cause of action in the previous suit was the 1st defendant's failure to give vacant possession of the land to the 2nd and 3rd defendants, whereas the present suit concerns the alleged fraudulent conveyance of the property by the 1st defendant to the 2nd and 3rd defendants. The issues and parties are therefore not the same. The applicants failed to provide pleadings from the previous suit to demonstrate identity of issues....
