Ratio Decidendi

The court found that the Claimant was declared redundant without notice or consultation, in breach of Section 40(1) of the Employment Act. The Respondent failed to justify the redundancy, especially as another employee was hired to fill the same position. The lack of consultation and failure to provide reasons rendered the termination unfair and unlawful. The Claimant was therefore entitled to compensation for unfair redundancy, payment in lieu of notice, and maintenance of the staff mortgage rate. The Respondent was ordered to pay the Claimant the awarded sums, issue a certificate of service, and bear the costs of the suit.
