Ratio Decidendi

The court held that the applicant, having unsuccessfully sought review of the impugned judgment, is barred by Section 80 of the Civil Procedure Act and Order 45 of the Civil Procedure Rules from subsequently seeking leave to appeal out of time against the same order. The law does not permit a party to challenge the same decision by both review and appeal, as this would amount to an abuse of court process and multiplicity of suits. The existence of a pending appeal (Thika Civil Appeal No. E048 of 2023) further renders the current application incompetent. The application was therefore found to be without merit and dismissed with costs to the respondents.
