Procedural Posture

Civil Appeal / Ruling on Application for Review of Security for Stay Order

  1. 1 Whether the application dated 9th August 2024 is sub judice.
  2. 2 Whether the applicant has satisfied the conditions warranted for review under Order 45 of the Civil Procedure Rules.

Ratio Decidendi

The court found that following the withdrawal of the earlier application dated 30th May 2024, the present application was not sub judice. However, on the substantive issue of review, the applicant failed to demonstrate discovery of new and important matter or evidence, mistake or error apparent on the face of the record, or any other sufficient reason as required under Order 45 of the Civil Procedure Rules. The applicant's inability to raise the decretal sum due to financial difficulties was not considered a sufficient ground for review. Consequently, the application for review lacked merit and was dismissed with costs.
