Procedural Posture

Employment and Labour Cause / Judgment

  1. 1 Whether the termination of the claimant's employment was procedurally fair.
  2. 2 Whether the respondent had valid and justifiable reasons for terminating the claimant.
  3. 3 Whether the claimant is entitled to compensation and other reliefs for unfair termination.

Ratio Decidendi

The court found that the respondent failed to follow due process in terminating the claimant's employment. No witnesses were called during the disciplinary hearing for the claimant to cross-examine, and the respondent did not constitute a Disciplinary Appeals Committee as required by its own policy. The respondent failed to prove the validity of the reasons for termination and did not demonstrate that fair procedure was followed. As a result, the termination was both procedurally and substantively unfair. The court awarded the claimant compensation equivalent to ten months' salary, ordered the issuance of a certificate of service, and awarded costs and interest to the claimant.

Court Disposition

Judgment for the claimant; termination declared unfair; compensation and other reliefs awarded.

Orders

  • Respondent to pay the claimant compensation equivalent to 10 months' salary (Kshs 1,579,930 less statutory deductions).
  • Respondent to issue the claimant with a certificate of service.
