The court found that the applicant satisfied the requirements for stay of execution pending appeal as set out in Order 42 Rule 6 of the Civil Procedure Rules. The application was filed within 25 days of judgment, which was not unreasonable delay. Substantial loss was demonstrated as the respondent could execute and dissipate the funds. Security had already been provided by depositing Kshs 652,000 in a joint interest earning account in the names of both advocates. The court therefore allowed the application for stay of execution pending the hearing and determination of the appeal, with the deposited funds to remain as security.
