Civil Case / Ruling on Notice of Motion to Lift Prohibitory Order

  1. 1 Whether the prohibitory order on LR No. LOC. 18/KIRERE/601 should be lifted after payment of all court-ordered costs by the judgment debtor.

Ratio Decidendi

The court found that the purpose of the prohibitory order was to secure payment of the costs awarded to the decree holder. Since the judgment debtor has paid all the costs as ordered by the court, there is no longer any justification for maintaining the prohibitory order. The court therefore allowed the application and ordered the lifting of the prohibitory order on LR No. LOC. 18/KIRERE/601.

Court Disposition

Application allowed; prohibitory order lifted.

Orders

  • The prohibitory order issued on 4th February 1986 prohibiting dealings in LR No. LOC. 18/KIRERE/601 is hereby lifted.
