The court found that getting up fees were improperly allowed because the case had never been confirmed for hearing, as required by the Advocates Remuneration Order. The sum of Kshs.69,400 paid to the advocates was confirmed and should have been credited. The court accepted that attendances at Kericho were properly charged as out of station, but attendances at Nakuru should be charged at the local rate. The court discounted the improperly allowed items and recalculated the bill of costs, resulting in a reduced sum. The application to review the taxation was allowed, and a rectified certificate of costs was ordered to issue for the sum of Kshs.435,417.
