Ratio Decidendi

The court held that the applicant had two clear opportunities to raise the issue of retainer: first, at the time of taxation of the advocate's bill of costs, and second, during the application for entry of judgment upon the taxed costs, when she was represented by counsel. Having failed to raise the issue at those stages, the applicant was now precluded from seeking to join another party and raise the same issue. The application for joinder was therefore without merit and was dismissed with costs.
