The Plaintiff failed to provide evidence of any disability or circumstances that would justify extension of time. Even if the suit were not time barred, the Plaintiff failed to strictly prove fraud as required by law, having not produced the title for parcel 1320 or documentary evidence to show that the 0.45 acres were fraudulently included in the 1st Defendant's title. The absence of such evidence meant the Plaintiff did not discharge the burden of proof for fraud....
