Procedural Posture

Civil Appeal / Ruling on Preliminary Objection

  1. 1 Whether the appeal was filed out of time without leave of the court in breach of Section 79G of the Civil Procedure Act.
  2. 2 Whether the preliminary objection raises a pure point of law and is merited.
  3. 3 Whether the delay in filing the appeal is inordinate or unreasonable.

Ratio Decidendi

The court found that although the appeal was filed nineteen days out of time and without leave, the delay was not inordinate or unreasonable. The discretion to enlarge time for filing an appeal is unfettered but must be exercised judiciously. In the interests of justice, the court determined that the preliminary objection should not be allowed, as doing so would prevent the court from hearing the substantive application on its merits. The court emphasized that justice should not be sacrificed for procedural technicalities, especially where the delay is not excessive and no prejudice has been demonstrated.

Court Disposition

Preliminary objection dismissed.

Orders
