The lease agreement provided for a monthly rent of Kshs. 160,000 for both premises, but the landlord's claim for additional arrears relating to a second premises was not substantiated by a separate written agreement. The Tribunal took judicial notice that commercial tenants are often granted a fit out period free of rent, especially where substantial renovations are undertaken, and found that the tenant was entitled to a six-month fit out period at a reduced rent of Kshs. 60,000 per month for one year, to be paid over a year.
