Ratio Decidendi

The applicant failed to provide any explanation for the inordinate delay of 105 days in filing the notice of appeal. The impugned ruling was delivered in the presence of counsel for both parties, and the applicant was required to file the notice of appeal within fourteen days. The absence of any effort to explain the delay deprives the Court of any basis to exercise its discretion in favour of the applicant. Furthermore, since the suit the applicant sought to join has already been heard and determined, the intended appeal is unlikely to succeed. Consequently, the application for extension of time is dismissed as totally devoid of merit.
