The High Court found that while the trial court correctly relied on precedent and considered the relevant injuries, the award of Kshs. 500,000/- as general damages for pain and suffering was on the higher side when compared to awards in similar cases. The court noted that the injuries proven were significant but not as severe as those in the authorities cited by the respondent. Taking into account the nature of the injuries, relevant precedents, and inflation, the court held that an award of Kshs. 350,000/- would be fair and reasonable compensation. The trial court's award was therefore set aside and substituted with this lower amount.
