Ratio Decidendi

The court found that the plaintiff, as administrator of the estate of the original owner and having participated in succession proceedings in 2001, was or ought to have been aware of the sub-division and registration of the disputed property as early as 1993, or at the latest by 2001. The court held that the limitation period for recovery of land runs from the date the right of action accrues, and that Section 26 of the Limitation of Actions Act only shifts the starting point to when fraud could reasonably have been discovered.
