Ratio Decidendi

The Court of Appeal held that the applicant had demonstrated the existence of arguable points in the intended appeal that were not frivolous and merited consideration at the hearing of the main appeal. Although the decree was for a money sum, the amount was substantial and the property at risk of sale was already held by the respondent as security. The court found that, balancing the interests of both parties, the property should be preserved pending the determination of the appeal. The court therefore granted a stay of execution of the High Court orders to prevent the disposal of the applicant's property before the appeal is heard, with costs to abide the outcome of the appeal.
