Constitutional Petition / Ruling on Jurisdiction and Merits of Petition Seeking Sentence Review

  1. 1 Whether the High Court has jurisdiction to review its own sentence imposed after a plea agreement.
  2. 2 Whether the sentence of ten years imprisonment for manslaughter violated the petitioner.s right to personal dignity under the Constitution.
  3. 3 Whether the petitioner was denied the right to mitigation before sentencing.

Ratio Decidendi

The High Court lacks jurisdiction to review its own sentence imposed after a plea agreement, except as to the legality of the sentence, which must be challenged by appeal to the Court of Appeal. The sentence of ten years for manslaughter is within the statutory maximum of life imprisonment and is therefore lawful. The petitioner was afforded an opportunity to mitigate, and there is no evidence of violation of his constitutional rights. The finality of judgments entered under plea agreements is provided for by statute, and the High Court is functus officio in this matter. Accordingly, the petition is dismissed for want of jurisdiction.

Court Disposition
