Ratio Decidendi

The court held that there is no statutory basis for awarding costs to a private prosecutor in criminal proceedings upon withdrawal of an appeal and application for stay, where there has been neither conviction nor acquittal. Both the Penal Code and Criminal Procedure Code only contemplate costs in the event of conviction or acquittal, and the Advocates Remuneration Order restricts costs in criminal cases to those between advocate and client, not between parties. The court found no exceptional circumstances to justify a departure from the general rule that costs are not awarded in criminal proceedings, and dismissed the 1st Respondent's plea for costs as lacking merit and not grounded in law.
