The High Court held that the order appealed from did not fall within those orders where an appeal lies as of right under Section 75(1) of the Civil Procedure Act. Since the appellants had not sought or obtained leave to appeal, the proceedings before the High Court were improperly commenced and the court lacked jurisdiction to entertain them. The existence of a counterclaim exceeding the Small Claims Court's pecuniary jurisdiction did not oust that court's jurisdiction over the main claim, as a counterclaim is a separate and independent claim. Accordingly, the proceedings were struck out with costs to the respondent.
