Ratio Decidendi

The court found that although substituted service was properly effected pursuant to court orders, and judgment was regularly entered as the claim was liquidated, the draft defences raised triable issues including the existence of a contract, delivery of goods, and the capacity of the 6th defendant to be sued. The court exercised its discretion to set aside the default judgment to allow the matter to be heard on its merits, holding that any prejudice to the plaintiff could be compensated by costs. The applications to set aside the judgment were therefore allowed, with thrown away costs to the plaintiff, and the defendants were granted leave to file and serve their defences within 14 days.
