Ratio Decidendi

The court found that the applicant failed to adequately explain the six-month delay in seeking leave to appeal out of time, as the only reason provided was late instruction to counsel without further justification. However, the court held that denying a party the right to appeal should be a last resort, especially where no prejudice to the respondent is demonstrated. Consequently, the court exercised its discretion to grant leave to appeal out of time and ordered a stay of execution on condition that part of the decretal sum be paid and the balance deposited in court within a specified period.
