The court held that the trial magistrate erred in finding that she lacked jurisdiction after a valid termination notice was served and the respondent failed to file a reference to the Tribunal. According to binding Court of Appeal authority, once the statutory notice takes effect and no reference is made, the controlled tenancy is terminated by operation of law, and the Tribunal's jurisdiction ceases. The ordinary courts then have jurisdiction to determine claims for vacant possession, rent arrears, and mesne profits. The trial magistrate failed to apply the doctrine of stare decisis and did not consider the relevant Court of Appeal decisions, leading to an erroneous dismissal of the suit...
