The High Court found that although the respondent’s delay in filing the suit was occasioned by the COVID-19 pandemic and related disruptions, the trial magistrate erred in law by granting leave to file suit out of time for a claim that was not for personal injuries but for material damage to a motor vehicle. Section 27 of the Limitation of Actions Act only permits extension of time for actions relating to personal injuries, not for property damage. The lower court failed to establish its jurisdiction and the legal basis for granting the application, as the respondent’s claim did not fall within the statutory exceptions for extension of time.
