Procedural Posture

Judicial Review Application / Application for Leave to Commence Judicial Review Proceedings

  1. 1 Whether the applicant has met the threshold for grant of leave to commence judicial review proceedings for orders of mandamus.
  2. 2 Whether the absence of the Court of Appeal judgment annexure is fatal to the application for leave.

Ratio Decidendi

The court found that while the applicant had annexed letters demanding payment and the Certificate of Costs, he failed to annex the judgment of the Court of Appeal, which forms the basis for the taxed costs. This omission meant that the threshold for an arguable case had not been met. However, rather than dismissing the application, the court granted the applicant leave to file and serve a supplementary affidavit annexing the certified copy of the judgment. The court further directed that the Chamber Summons would be heard on a future date, and set out directions for electronic filing and service in light of COVID-19 protocols.

Court Disposition

Leave to file supplementary affidavit granted; directions for hearing and electronic filing issued.

Orders

  • The applicant is granted leave to file and serve a supplementary affidavit annexing the certified copy of the judgment by the Court of Appeal in Kisumu Civil Appeal Number 44 of 2013.
  • The Chamber Summons dated 10th November 2020 shall be heard on 26th January 2021.
