The matter is pending before the Court of Appeal, awaiting constitution of a bench to hear the application for stay and extension of time. The court held that it is in the interest of justice to grant a stay of execution of the judgment and decree pending the determination of the appeal, to avoid rendering the appeal nugatory and to balance the interests of both parties. The court also noted that the proceedings have been typed and directed that the record of appeal be prepared and forwarded to the Court of Appeal forthwith.
