The only documentary evidence of payment was a joint receipt for Kshs. 4,000/- in both Nyachiro and Onchwari's names, and there was no proof that Nyachiro paid for the share to the exclusion of the others. The dispute over the share was conclusively settled by a consent order in HCCC No. 80 of 1973, which allocated 11.5 acres each to Gori Kibondori and Onchwari Mogaka.
