The High Court lacks jurisdiction to entertain an application for resentencing where the impugned sentence was imposed by the Court of Appeal. The supervisory and revisionary powers of the High Court under Article 165(6) of the Constitution and sections 362-366 of the Criminal Procedure Code are limited to subordinate courts and do not extend to superior courts such as the Court of Appeal. The Judiciary Sentencing Policy Guidelines 2023 reinforce that resentencing must be sought from the court that last imposed the sentence. As the applicant's sentence was enhanced to life imprisonment by the Court of Appeal, only that court has jurisdiction to consider any application for resentencing....
