Miscellaneous Criminal Application / Ruling on Application for Review of Sentence

  1. 1 Whether the High Court can review a sentence after an appeal on the same sentence has been dismissed.
  2. 2 Whether the period spent in pre-sentence remand custody should be factored into the applicant's sentence.

Ratio Decidendi

Once an appeal against conviction and sentence has been determined and dismissed by the High Court, the court becomes functus officio and lacks jurisdiction to entertain a subsequent application for review of the same sentence. The applicant, having already appealed and had the sentence upheld, cannot seek a second review of the sentence on the same grounds. The doctrine of functus officio precludes the court from reopening the matter, and the application for review is therefore dismissed.
