The court found that while the Tribunal was correct in including the entire area occupied by the appellant, including the extensions, as part of the lettable area, it erred in awarding a rent higher than what was demanded in the landlord's notice. The landlord was bound by the notice dated 25.02.2021, which sought to increase the rent to Kshs. 15,000 per month. Therefore, the Tribunal's award of Kshs. 30,000 was set aside and replaced with Kshs. 15,000 per month effective from 01.01.2024. Each party was ordered to bear their own costs as the respondent did not oppose the appeal.
