Miscellaneous Application / Ruling on Application for Transfer of Suit

  1. 1 Whether the Environment and Land Court has jurisdiction to transfer a suit from one subordinate court to another under section 18 of the Civil Procedure Act.
  2. 2 Whether the suit should be transferred from the Chief Magistrates’ Court Kisii to the Chief Magistrates’ Court Nyamira given the location of the subject land.

Ratio Decidendi

The court found that section 18 of the Civil Procedure Act empowers it to transfer suits between subordinate courts. Since the subject matter of the dispute, being land parcel Ekerubo Settlement Scheme/255, is located in Nyamira County, the proper venue for the suit is the Chief Magistrates’ Court Nyamira. There was no opposition to the application, and the court saw no reason to decline the request. Accordingly, the application for transfer was allowed to ensure the suit is heard in the court with proper territorial jurisdiction over the subject land.
