The Tribunal found that the landlord's notices of rent increment and termination were not compliant with the statutory requirements under the Landlord and Tenant (Shops, Hotels and Catering Establishments) Act and its Regulations. The notices were not in the prescribed form and did not provide the required notice period, rendering them null and void. The Tribunal further determined that the tenant was up to date with rent payments at the lawful rate of Kshs.6,000 per month, and there were no arrears as alleged by the landlord.
