Procedural Posture

Objection Application / Ruling on Objection to Attachment and Sale of Property

  1. 1 Whether the objector, Hyatt Hotels International Limited, has a legal or equitable interest in the property subject to attachment and sale in execution of a decree against the claimant.
  2. 2 Whether the property in question can be lawfully attached and sold to satisfy the decree against the claimant.
  3. 3 Whether payment of land rates by the claimant confers ownership or sufficient interest to defeat the objector's claim.

Ratio Decidendi

The court found that the objector, Hyatt Hotels International Limited, provided sufficient evidence of ownership of the property in question as of November 19, 2009, and that there was no evidence of the property reverting to the claimant. The mere payment of land rates by the claimant did not confer ownership or a sufficient legal interest to defeat the objector's claim. The respondents failed to demonstrate that the property was held by the claimant for itself or in trust for the judgment debtor at the time of attachment. Accordingly, the property could not be lawfully attached or sold in execution of the decree against the claimant, and the prohibitory order was discharged.

Court Disposition

Objection allowed; prohibitory order discharged; each party to bear own costs.
