Legal Issues
- 1 Whether the court can adopt as judgment the award of the Director of Occupational Safety and Health Services without the requisite Dosh Form 4 being filed.
- 2 Whether judgment can be entered for the applicant for the amount assessed under the Work Injury Benefits Act in the absence of the Director's formal decision.
Ratio Decidendi
The court determined that it cannot proceed to adopt the Director of Occupational Safety and Health Services' award or enter judgment for the applicant in the absence of Dosh Form 4 or any other document evidencing the Director's formal decision under the Work Injury Benefits Act. The court emphasized that the filing of such a document is essential for the just determination of the application. Accordingly, the court directed the applicant to file a supplementary affidavit attaching Dosh Form 4 or an equivalent document, and granted the respondent leave to respond, before the matter could proceed to ruling.
Court Disposition
directions issued; application not determined on merits pending filing of required documents
Orders
- The applicant shall file a supplementary affidavit within seven days and place before the court Dosh Form 4 or such other document containing the Director's decision, if it exists.
- The respondent may file a further affidavit in response upon being served with the supplementary affidavit, if necessary.
