The court found that the suit in the lower court had already been concluded and the appeal only related to execution of the decree, not the judgment itself. The Appellant failed to demonstrate what proceedings remained to be stayed or how he would be prejudiced by their continuation, so the prayer for stay of proceedings was declined. However, regarding stay of execution, the court noted that the Appellant lawfully repossessed the vehicle pursuant to a decree, and has remained in possession since. Disrupting the status quo by ordering release of the vehicle to the 2nd Respondent at this stage would cause greater loss and inconvenience to the Appellant than to the 2nd Respondent. The court...
