Ratio Decidendi

The court found that as of January 2019, the offence of 'Careless Driving' no longer existed in Kenyan law, having been replaced by 'Driving without due care and attention' through statutory amendment. Charging and convicting the appellant for an offence not known in law contravened Article 50(2)(n) of the Constitution, which protects against retrospective criminal liability. The charge sheet was therefore fatally defective, and the entire prosecution was unconstitutional. As a result, the conviction and sentence could not stand, and the appeal was allowed in full.
