The court held that the application for transfer of the suit from the Magistrates’ Court to the Environment and Land Court was merited. The applicants had amended their pleadings to challenge the validity of a judgment previously issued by the Environment and Land Court, alleging fraud. Since a subordinate court lacks jurisdiction to nullify or impugn a judgment of a superior court, the Magistrates’ Court could not entertain such a challenge. Section 18 of the Civil Procedure Act empowers the superior court to transfer suits from subordinate courts to itself for trial or disposal.
