The Tribunal found that the issue of whether the respondent was a member or employee of the applicant is not a pure point of law but a factual matter requiring evidence, and thus not suitable for determination by way of preliminary objection. The Tribunal further held that the respondent's argument on limitation of actions was unfounded, as the date of default, not the date on the loan application form, is relevant for reckoning limitation, and there was insufficient evidence to establish that the claim was statute barred. Consequently, the preliminary objection failed on both grounds.
