The High Court determined that it lacks jurisdiction to entertain the defendant's application for restitution because the Court of Appeal had already ordered the release of the deposited funds to the plaintiff. The High Court cannot issue orders that would have the effect of reversing or contradicting the appellate court's decision. Where the effect of an appellate decision is unclear or disputed, only the appellate court itself, preferably the original bench, can clarify its intent. Therefore, unless and until the Court of Appeal clarifies its decision, the High Court is not competent to address the application for restitution.
