Ratio Decidendi

The court held that dismissal of an appeal for want of prosecution under Order 42 Rule 35 of the Civil Procedure Rules is only available after directions have been given under Order 42 Rule 13. In this case, there was no evidence that directions had been given, nor that the registrar had issued the requisite notice or that the lower court file had been forwarded to the High Court. Therefore, the procedural requirements for dismissal had not been met. The court further found that allowing the application would unjustly deny the appellant access to justice, contrary to Article 50 of the Constitution. Consequently, the respondents' application for dismissal was not merited and was dismissed....
