Procedural Posture

Stay Application / Application for Stay of Proceedings Pending Appeal

  1. 1 Whether the Disciplinary Committee of the Law Society of Kenya had jurisdiction to entertain a complaint previously filed with the Advocates' Complaints Commission.
  2. 2 Whether the applicants were entitled to an order of stay of proceedings pending appeal.
  3. 3 Whether judicial review was the appropriate remedy to challenge the Disciplinary Committee's decision on jurisdiction.

Ratio Decidendi

The Court found that the Advocates' Complaints Commission had not made a determination on the merits of the complaint, but had merely closed its file and advised the complainant. As such, the complainant was not barred from lodging the same complaint with the Disciplinary Committee, which had jurisdiction to entertain it under section 60 of the Advocates Act. The Court further held that judicial review was not the appropriate remedy to challenge the Committee's decision on jurisdiction, as the proper recourse was by way of appeal. The applicants failed to demonstrate that their appeal was arguable, and therefore did not satisfy the conditions for the grant of a stay of proceedings....
