The High Court held that the Deputy Registrar (taxing officer) was correct in determining as a preliminary issue whether she had jurisdiction to tax a party and party bill of costs arising from a matter determined in the subordinate court. The Advocates Remuneration Order and relevant case law make clear that costs in subordinate court matters are to be assessed in the subordinate court itself, not taxed by the High Court's Deputy Registrar. The applicant, having obtained judgment for costs in the magistrate's court, should have filed the bill for assessment in that court.
