The court found that while the Kuria custom of posthumous marriage exists, the defendants failed to prove that Esther Kholera was married on behalf of the late Magoiga Gimachombe. The evidence showed that Esther was the second wife of Chacha Gimachombe Weisei, and her nine children are his, not those of the deceased son. Therefore, the children of Esther are not entitled to inherit as children of the late Magoiga Gimachombe.
