Ratio Decidendi

The trial court erred by failing to consider the period the applicant spent in pre-trial custody when passing sentence, contrary to Section 333(2) of the Criminal Procedure Code and the Judiciary Sentencing Policy Guidelines. The High Court, exercising its revisionary jurisdiction, found the omission resulted in an excessive sentence and that the applicant was entitled to have the sentence computed from the date of arrest. The application for revision was therefore merited and allowed, with the applicant's sentence ordered to commence from the date of arrest, 22nd September 2021.
