The court found that the cause of action for breach of contract accrued when the respondent failed to harvest the 1st ratoon crop, which was on or about 14/7/2009. Under Section 4(1)(a) of the Limitation of Actions Act, the appellant was required to file suit within six years from that date, i.e., by 14/7/2015. The suit was instead filed on 17/8/2016, outside the statutory limitation period, and there was no evidence that the appellant sought or obtained leave to file the suit out of time. Consequently, the suit was statute barred and non-suited. The trial magistrate was correct in dismissing the suit, and the appeal lacked merit.
