Ratio Decidendi

The court found that the applicant, having served a substantial portion of his sentence and based on the positive recommendation from the probation officer, was eligible to serve the remainder of his sentence under a Community Service Order. The court also considered the period the applicant spent in custody prior to sentencing, in compliance with Section 333(2) of the Criminal Procedure Code. Accordingly, the court directed that the applicant serve the Community Service Order at Mogweko Assistant Chief’s Office until 17/9/2022, rather than the initially proposed 25/9/2022, to properly account for time already served.
